According to a probable cause affidavit, on April 3, a Winona Lake police officer yielded to a silver Subaru Outback at the roundabout at the intersection of Kings Highway and Park Avenue on the edge of Warsaw and Winona Lake.

The officer saw the Subaru use the incorrect lane before turning on Kings Highway and the driver of the Subaru poorly negotiate the turn, drifting into a left hand turn lane for a business before correcting.

The officer followed the Outback and saw the vehicle’s speed vary significantly.

Upon pulling over the driver, later identified as Naue, the officer saw she had bloodshot, watery eyes and her speech was slurred. He also smelled the strong odor of an alcoholic beverage coming from the vehicle.

The officer also observed Naue had trouble using her hands while getting her driver’s license.

When asked by the officer to exit her vehicle, Naue stumbled and was unsteady on her feet.

She failed several field sobriety tests administered by the officer.

Naue’s blood was drawn, with her lab results measuring 0.246% blood alcohol content.

Her initial hearing was on May 19 in Kosciusko Superior Court 2, overseen by Judge Torrey Bauer. Hartley was sworn in as special prosecutor for the case on June 5.
